After the man’s death in 2022, a lawsuit was filed against Height’s legal team

Houston – Nearly two years after a 26-year-old man was found in the Houston Ship Channel, the man’s family is now filing a wrongful death lawsuit.

Delano Burkes was found in the water in November 2022.

Now his family is alleging negligence on the part of a bar in the Heights.

Burkes’ family says the last place he was seen or heard from was at McIntyre’s on 20th Street.

The lawsuit, filed Friday, alleges the bar served too much alcohol to Burkes and forcibly removed him from the establishment, knowing he was drunk.

It goes on to say that staff knew Burkes needed help to “prevent serious injury or death” and that he could not make it safely back to his home or elsewhere.

They say McIntyre failed to “implement” and “monitor” policies to keep customers safe.

Burkes went missing on November 13th. After that, the search began, and Texas Equusearch even got involved. It wasn’t until November 25th that tugboat workers found his body in the Houston Ship Channel.

The family is demanding more than a million dollars.
